Legal Requirements

 

I have out lined the legal requirements for the service for you below.

 

These MUST be included for your wedding to be legally recognised under Australian Law. 

 

 

 

 

The Monitum – This must be included in the ceremony. Usually during the introduction.  (The words in Bold must be said)

 

E.g.

 

 

 

My name is Carol Ann C, and as a registered Marriage Celebrant, I am duly authorized by law to solemnize marriages according to the law. I am honored today to welcome you all in this celebration of the love and marriage between ...............

 

 

 

 

 

Before you are joined in marriage in my presence and in the presence of these witnesses, I am to remind you of the solemn and binding nature of the relationship into which you are now about to enter.

Marriage, according to law in Australia, is the union of two people to the exclusion of all others, voluntarily entered into for life.

The vows – (The words in bold must be said) your chosen vows can then be said.

 

These words must be included in the ceremony. They are the minimum words which must be exchanged by the couple to ensure that they fully understand the nature of the ceremony and that they are marrying each other.

Subsection 45(2) requires that each party say to the other, in the presence of an authorised celebrant (who is not a minister of religion) and the witnesses, the words:

 

‘I call upon the persons here present to witness that I, A.B. (or C.D.), take thee, C.D. (or A.B.), to be my lawful wedded wife (or husband or spouse)’

The term ‘husband’ can refer to a male marriage partner, and ‘wife’ to a female marriage partner, regardless of the sex or gender of the person saying the vows. The term ‘spouse’ can refer to a male, female, intersex, non-binary gender or transgender person.

 

 

                          The Notice of Intended Marriage

 

In order to be legally married in Australia all couples must complete an application form known as a Notice Of Intended Marriage (NOIM) If you have pre filled the details of the NOIM that you can we will finalise that form (if possible)

 

You must both be aged over 18. If you are younger, you can apply for special permission through the courts.

The NOIM must be completed at least one calendar month before your wedding day and is valid for 18months.

I must see an original copy of your full Birth Certificate (if you’re Australian born or a naturalised citizen). If you were born overseas, I need to see your original birth certificate or passport.

If you’ve been married before, I must see your original Decree Absolute of Divorce or Certificate of Divorce or your previous spouse’s Death Certificate.

 

I must also be satisfied you are who you say you are so please bring photo ID if possible.

We will also need to sign  a forn 14

This simply states you are legally free to marry

 

 

 

Once this is done the rest of the legalities are my responsibly and you can relax.  PHEW
